The following is a summary of requirements and benefits in conjunction with the terms and conditions of your employment by clients of the V Ships Group for service on board vessels in the V Ships Group managed fleet (the “Fleet”). Benefits are provided to you by the Company in consideration of your being available for service on board vessels in the Fleet on the joining dates and for such periods as the Company may reasonably request. 1 EMPLOYMENT 1.1 Letters of Appointment detailing the vessel type and your employer (the registered owner of the vessel – referred to as the ‘Owner’) will be issued to you by the Company on behalf of the Owner from time to time in accordance with the vessel or vessel type to which you are appointed. 1.2 The date of your first Letter of Appointment is: Date: 1.3 Your date of seniority is: Date: Being the date that your period of service with the Fleet began in your current Rank or, if transferred from a shipping company, the date at which it has been agreed that you begin accruing suitable experience in your current Rank. 1.4 The Company is a crewing agency, operating as agents for and on behalf of owners of the Fleet. Employment benefits are provided and administered on behalf of the owners and at no stage is the Company the direct employer of any seafarer. 2 COUNTRY OF RESIDENCE 2.1 Your country of residence is (Country) or any substitute agreed by the Company. 3 SHIPBOARD SERVICE 3.1 You agree to transfer between vessels as may be required by the Company. 3.2 Transfer between vessels may result in changes to work/leave pattern and minor changes in remuneration. 3.3 The Company shall use its best endeavours to procure in any year the number of months of service on board the Fleet as may be requested by you. 4 JOB CLASSIFICATION AND DESCRIPTION 4.1 The position for which you are employed is stipulated in your Letter of Appointment. You are required to perform all duties of this position as described in the job description. 5 WORK/LEAVE ROTATION 5.1 Your work/leave rotation will be in accordance with the vessel or vessel type to which you are appointed. 5.2 You will be advised of intended work/leave rotations on appointment to your first vessel and you will be contacted by the Company during leave periods to confirm the next appointment date. 5.3 If you are unable to fulfil the requirement, you must give at least one months notice in writing to the Company and you must restate your readiness date. 5.4 You will be entitled to stand-by pay that will be paid at the basic rate of pay for a maximum period of 30 days commencing at a date agreed with the Company that commences after your normal leave period has completed, provided that you are ready in all respects for seagoing assignment and a minimum of 15 days notice has been provided by you to the Company in writing. 6 TRAVEL 6.1 When international air travel is required, flight arrangements from an agreed airport will be made and paid for by the Company. Flights will be economy class and the baggage allowance will be in accordance with the airline. 6.2 Domestic travel arrangements will be by the most appropriate means and full use must be made of public transport. If air travel is required, arrangements will be made by the Company. Reasonable incidental expenses may be reclaimed from the Company. 6.3 When travelling to/from a vessel you must always carry a valid seaman’s book and passport, have valid visas and vaccinations as specified by the Company. 6.4 Passport and Seaman’s book renewal is for your own account. 7 TRAINING AND QUALIFICATIONS 7.1 You must attend and successfully complete those training courses determined as being necessary to fulfil the requirements of international and/or national legislation and Company requirements. 7.2 It is your responsibility to provide the Company with copies of all your current qualifications and training certificates. 7.3 Should your qualifications or certificates not meet the training, educational or safety requirements of the Company, its clients or any proper authority, the Company may arrange for you to undergo suitable training and/or education. You will be required to assist in this by keeping yourself available for such training and/or education periods, in order that the above requirements may be met without delay. Such training or educational activities will usually take place in your leave periods and will not use or earn leave. 7.4 Basic pay will be paid for pre-joining and career development training specific to the Company, vessel or its SMS and approved by the Company. This will be paid after joining the next vessel. 7.5 The Company will reimburse fees directly associated with the revalidation of national certificates of competency. This includes fees payable to national administrations and fees for training courses required to revalidate the certificate of competence. This will be paid after joining the next vessel provided pre-approval from the Company is provided in writing. 8 MEDICAL EXAMINATION 8.1 Your employment with the Owner is conditional upon completing a medical examination and providing a medical certificate, which is satisfactory to the Company and complies with international standards and you must at all times hold a valid medical certificate which is satisfactory to the Company and which complies with international and national standards. You agree that the examining doctor(s) will provide the results of any examinations to the Company. The Company will reimburse approved medical expenses. 9 MEDICAL COVER 9.1 The Company will provide a medical plan to cover all senior officers (Master, Chief Engineer, Chief Officer and Second Engineer) who are covered by this Agreement (with the exception of officers residing in China, Myanmar and Italy) while on leave and annual cover for the senior officer’s immediate spouse/partner and legal dependents in accordance with the terms of the medical plan provider. The medical plan will be effective from the start date of this agreement until terminated by either party. For the purposes of the medical plan coverage, the length of leave shall not be more than the previous contracted assignment period, unless otherwise agreed with the Company in writing. 10 TERMINATION 10.1 This Agreement can be terminated by either party by giving 30-days notice in writing.
